Due to the spread of the coronavirus SARS-Cov2, which spread COVID-19, the Republic of Serbia declared a state of emergency on March 15, 2020, and the government has taken measures to prevent the spread of infection.
All measures will affect the lives of enterprises, legal persons and entrepreneurs, as well as employees and employers in one way or another. It mainly refers to the restrictions on freedom of movement and freedom of assembly, as well as restrictions on working hours in companies, cafes, restaurants, bars, shopping malls, and the market and related work organization obligations.
In addition, the government has also taken the following measures: restricting the retail prices and profits of certain products, restricting the organization of games of chance, export bans on medicines and certain disinfectants, prohibiting the export of certain food and protective equipment, and quarantine animals. . Employees from abroad and restrictions on public transportation have caused problems with employee transportation.
Regarding these restrictions (which will be expanded soon), the question is how to organize the work of enterprises, legal persons and entrepreneurs? Employers must respond quickly to such measures when organizing the company’s work processes, otherwise, they may find violations of the regulations. The regulations are promulgated daily and apply immediately to all employers.
Employers, directors, managers, and other competent authorities within the company are responsible for taking such measures because they manage a large number of employees and determine business activities within the company. These measures protect the basic constitution and human rights-the right to life, so they are more likely than ever to handle the entire process and avoid criminal charges, litigation and inspection measures.
On March 16, 2020, the Government of the Republic of Serbia issued a decree on organizing the work of employers in a state of emergency (RS Official Gazette, No. 31/2020), which compels employers to allow employees to work from home. , And take alternative measures under the conditions of the law.
Employers who can organize their employees to work from home are more likely to organize their business activities legally. This mainly refers to businesses that engage in activities that do not strictly depend on the location of the employer. However, another group of employers will definitely be more affected. This applies to companies that work 9 to 5, as well as companies that work in shifts and nights.
Taking into account the state of emergency, if the employer intends to continue its business activities, it must organize the work process in accordance with the prescribed measures. These measures have a very significant impact on the company. Therefore, here, we will try to point out all types of organizational work from the perspective of the prescribed measures and the Employment Law. It should be emphasized that in order to determine the mode of organizational work, every employer should carefully consider every detail. In order to take any of the following measures, every action taken by the employer must be thoroughly analyzed and demonstrated. Otherwise, the employee may find a way to file a claim against the employer in order to realize their legitimate rights and interests.
